La marine isra&eacute;lienne a saisi un bateau rempli d&#39;armes qui ont pour but de tuer des civils isra&eacute;liens, et les armes venaient d&#39;Iran. Sous la Loi Internationale, ce n&#39;est pas le 1<sup>er<\/sup> acte de guerre de l&#39;Iran qui aurait justifi&eacute; une r&eacute;ponse militaire d&#39;Isra&euml;l. L&#39;Iran a d&eacute;j&agrave; exp&eacute;di&eacute; nombre de cargaisons d&#39;armes anti-personnel au Hamas et au Hezbollah. De plus, en 1992, les dirigeants iraniens ont con&ccedil;u et autoris&eacute; l&#39;attaque meurtri&egrave;re contre l&#39;ambassade d&#39;Isra&euml;l &agrave; Buenos Aires. Men&eacute;e par des agents iraniens, cette attaque &eacute;tait d&eacute;j&agrave; un acte de guerre contre Isra&euml;l, l&#39;ambassade faisant partie du territoire souverain du pays.<\/p>\n<p>\n\tEn dehors de ceci, le gouvernement iranien a publiquement clam&eacute; &agrave; plusieurs reprises qu&#39;Isra&euml;l devait &ecirc;tre ray&eacute; de la carte, une d&eacute;claration de guerre contre ce pays.<\/p>\n<p>\n\t&nbsp;<\/p>\n<p>\n\tSelon la loi internationale, ces actes de guerre &ndash; appel&eacute;s &quot;casus belli&quot; &ndash; justifient pleinement une riposte arm&eacute;e. M&ecirc;me la charte de l&#39;Onu autorise une r&eacute;ponse unilat&eacute;rale &agrave; une attaque arm&eacute;e. Fournir des armes &agrave; un ennemi d&eacute;clar&eacute;, soumis &agrave; un embargo, a toujours &eacute;t&eacute; consid&eacute;r&eacute; dans l&#39;histoire comme un acte de guerre, selon les lois de la guerre; d&#39;autant plus que les fournisseurs de ces armes ont pour objectif qu&#39;elles soient utilis&eacute;es contre des civils. Il en est de m&ecirc;me du dynamitage d&#39;une ambassade.<\/p>\n<p>\n\t&nbsp;<\/p>\n<p>\n\tDeux autres &eacute;v&egrave;nements r&eacute;cents renforcent le droit d&#39;Isra&euml;l d&#39;utiliser les moyens militaires pour emp&ecirc;cher l&#39;Iran de continuer &agrave; armer ses ennemis. Le d&eacute;sastre au Japon montre l&#39;extraordinaire danger pr&eacute;sent&eacute; par des radiations atomiques. Si quelqu&#39;un pouvait encore douter des effets d&eacute;vastateurs d&#39;&quot;une bombe sale&quot;, &agrave; la fois physiquement et psychologiquement, ces doutes s&#39;estompent, avec ce que vivent les Japonais. Si l&#39;Iran poursuit son programme nucl&eacute;aire, un prochain bateau vers Gaza pourrait contenir une bombe sale, et Isra&euml;l pourrait ne pas l&#39;intercepter. Si une bombe sale explosait, elle causerait d&#39;&eacute;normes dommages aux civils en Isra&euml;l et dans la r&eacute;gion.<\/p>\n<p>\n\t&nbsp;<\/p>\n<p>\n\tDe m&ecirc;me, le r&eacute;cent massacre d&#39;une famille &agrave; Itamar, incluant 3 jeunes enfants, montre les moyens utilis&eacute;s par les ennemis d&#39;Isra&euml;l contre des civils, en violation totale des lois de la guerre. L&#39;Iran a arm&eacute; des tueurs de b&eacute;b&eacute;s, et le Hamas les a f&eacute;licit&eacute;s.<\/p>\n<p>\n\tChaque pays a le droit de prot&eacute;ger ses citoyens et de pr&eacute;venir des massacres, notamment les armes de destruction massive qu&#39;envoie l&#39;Iran. Ce dernier pays n&#39;a aucun moyen l&eacute;gal pour protester contre une attaque chirurgicale contre ses implantations nucl&eacute;aires, fabriquant des armes destin&eacute;es &agrave; &ecirc;tre utilis&eacute;es pour atteindre l&#39;objectif publiquement d&eacute;clar&eacute; de l&#39;Iran, rayer Isra&euml;l de la carte et tuer des millions de citoyens.<\/p>\n<p>\n\t&nbsp;<\/p>\n<p>\n\tLes dirigeants iraniens ont maintes fois d&eacute;clar&eacute; publiquement qu&#39;une guerre nucl&eacute;aire, tuant des millions de Juifs et de Musulmans &eacute;tait &quot;acceptable&quot; pour eux, parce qu&#39;&eacute;liminant Isra&euml;l, mais causant quelques dommages &agrave; l&#39;Islam.<\/p>\n<p>\n\tUne nation suicidaire ne peut &ecirc;tre dissuad&eacute;e par des menaces de repr&eacute;sailles. La seule option r&eacute;aliste est une attaque pr&eacute;ventive, comme celle men&eacute;e contre le r&eacute;acteur nucl&eacute;aire d&#39;Irak en 1981. Cette attaque chirurgicale a sauv&eacute; nombre de vies, &agrave; un co&ucirc;t relativement faible. Rappelons que l&#39;Iran avait d&eacute;j&agrave; essay&eacute; de d&eacute;truire la capacit&eacute; nucl&eacute;aire de l&#39;Irak, sans succ&egrave;s. Isra&euml;l a le droit de faire ce que l&#39;Iran a essay&eacute; de faire contre l&#39;Irak&nbsp; &#8212; emp&ecirc;cher un ennemi mortel de d&eacute;velopper des moyens de destruction massive contre ses citoyens.<\/p>\n<p>\n\t&nbsp;<\/p>\n<p>\n\tCeci ne veut pas dire qu&#39;Isra&euml;l doive attaquer maintenant les r&eacute;acteurs nucl&eacute;aires de l&#39;Iran. Avoir le droit de le faire ne signifie pas qu&#39;il ne faille pas choisir le moment opportun. Les lois de la guerre ne supposent pas des ripostes imm&eacute;diates. La nation attaqu&eacute;e peut surseoir &agrave; la contre attaque, sans que son droit ne faiblisse. L&#39;option militaire ne peut &ecirc;tre que le dernier recours, apr&egrave;s que tous les autres aient &eacute;chou&eacute;.<\/p>\n<p>\n\tIl est possible que d&#39;autres moyens puissent d&eacute;finitivement mettre l&#39;Iran hors d&#39;&eacute;tat de nuire. Les sanctions &eacute;conomiques ne parviendront pas &agrave; dissuader les z&eacute;lotes de l&#39;id&eacute;ologie de l&#39;apocalypse de mettre fin &agrave; leur programme nucl&eacute;aire. Une combinaison de diff&eacute;rents moyens peu ralentir ce programme, jusqu&#39;au point de rendre une intervention militaire moins urgente.<\/p>\n<p>\n\tSous aucun pr&eacute;texte, on ne doit renoncer &agrave; l&#39;option militaire et Isra&euml;l doit conserver sa capacit&eacute; d&#39;exercer son droit fondamental d&#39;une auto-d&eacute;fense pr&eacute;ventive. Si cela est possible, ce pays pourrait ne pas agir seul, et si n&eacute;cessaire, il doit le faire seul. Tout le monde esp&egrave;re qu&#39;on n&#39;en arrivera pas l&agrave;, mais l&#39;esp&eacute;rance n&#39;est pas une politique.<\/p>\n<p>\n\tComme l&#39;a averti George Washington lors de l&#39;inauguration de son 2<sup>&egrave;me<\/sup> mandat:<\/p>\n<p>\n\t<strong>&quot;Se pr&eacute;parer &agrave; la guerre est le moyen le plus efficace pour pr&eacute;server la paix !&quot;<\/strong><\/p>\n<p>\n\t&nbsp;<\/p>\n<p>\n\t&nbsp;<\/p>\n<p>\n\t<strong>Israel&nbsp;<\/strong><strong>and Iran&rsquo;s Nuclear Reactors<\/strong><\/p>\n<p>\n\t&nbsp;<\/p>\n<p>\n\tBy <a href=\"http:\/\/frontpagemag.com\/author\/alan-m-dershowitz\/\" title=\"Posts by Alan M. Dershowitz<\/a><\/p>\n<p>\n\tFrontPageMagazine.com &#8211; Mar 18th, 2011<\/p>\n<p>\n\t&nbsp;<\/p>\n<p>\n\tIran&rsquo;s recent attempt to ship arms to Hamas in Gaza is an act of war committed by the Iranian government against the Israeli government.&nbsp; The Israeli Navy seized <u>the ship<\/u>, loaded with weapons designed to kill Israeli civilians, and traced the weapons back to Iran.&nbsp; Nor is this the first act of war that would justify a military response by Israel under <u>international law<\/u>.&nbsp; Iran has sent other boatloads of anti personnel weapons to Hamas and Hezbollah.&nbsp; In addition, back in 1992, the Iranian leaders planned and authorized a deadly attack on Israel&rsquo;s embassy in Argentina.&nbsp; That bombing, which was carried out by Iranian agents, constituted a direct armed attack on the state of Israel, since its embassy is part of its sovereign territory.&nbsp; Moreover, the Iranian government has publicly declared war on Israel by calling for it &ldquo;to be wiped off the map.&rdquo;<\/p>\n<p>\n\tUnder international law, these acts of war&mdash;known as Casus Belli&mdash;fully justify an Israeli armed response.&nbsp; Even the UN Charter authorizes a unilateral response to an armed attack.&nbsp; Providing weapons to a declared enemy in <u>the face<\/u>of an embargo has historically been deemed an armed attack under <u>the law<\/u>of war, especially when those providing the weapons intend for them to be used against the enemy&rsquo;s civilians.&nbsp; So too is the bombing of an embassy.<\/p>\n<p>\n\tTwo other recent events enhance Israel&rsquo;s right use military means to prevent Iran from continuing to arm Israel&rsquo;s enemies.&nbsp; The recent disaster in Japan has shown the world the <u>extraordinary<\/u>dangers posed by nuclear radiation.&nbsp; If anybody ever doubted the power of a dirty bomb to devastate a nation, both physically and psychologically, those doubts have been eliminated by what is now going on in Japan.&nbsp; If Iran were to develop nuclear weapons, the next ship destined to Gaza might contain a nuclear dirty bomb and Israel might not intercept that one.&nbsp; A dirty bomb detonated in tiny Israel would cause incalculable damage to civilian life.<\/p>\n<p>\n\tMoreover, the recent killings in Itamar of a family including three children, demonstrate how weapons are used by Israel&rsquo;s enemies against civilians in violation of the laws of war.&nbsp; Even babies are targeted by those armed by Iran.&nbsp; Hamas praised the murders.<\/p>\n<p>\n\tIshas the right to prevent its civilians from being murdered by Iranian weapons, especially weapons of mass destruction.&nbsp; Iran would have no legal standing to protest a surgical attack on its nuclear facilities that are designing weapons that could be used to achieve Iran&rsquo;s declared <u>goal<\/u>of wiping Israel off the map and killing millions of its <u>citizens<\/u>.&nbsp; The <u>leaders<\/u>of Iran have publicly declared that a nuclear exchange, killing millions of Jews and Muslims, would be acceptable to them because it would destroy Israel while only damaging Islam.&nbsp; A suicide nation cannot be deterred by the threat of retaliation.&nbsp; Israel&rsquo;s only realistic option may be a preventive military strike of the kind it conducted against Iraq&rsquo;s nuclear reactor in 1981.&nbsp; That surgical attack may have saved countless lives at the cost of one single casualty.&nbsp; By the way, Iran too tried to destroy Iraq&rsquo;s nuclear reactor, but failed.&nbsp; Certainly Israel has the right to do what Iran itself tried to do&mdash;namely prevent a lethal enemy from developing weapons capable of mass murder of its citizens.<\/p>\n<p>\n\tThis is not to say that Israel should attack Iran&rsquo;s nuclear reactors now.&nbsp; That is has the right to do so does not mean that it should not wait for a more opportune time.&nbsp;&nbsp; <u>The law<\/u>of war does not require an immediate military response to an armed attack.&nbsp; The nation attacked can postpone its counterattack without waiving its right.&nbsp; The military option should always be a last resort after all other efforts have failed.&nbsp; It may well be that efforts to permanently disable Iran&rsquo;s nuclear <u>computers<\/u>will succeed.&nbsp; Although it is unlikely that economic sanctions will ever persuade Iran&rsquo;s ideological zealots to end their nuclear weapons program, a combination of quasi military, tough economic and diplomatic sanctions may slow it down to a point where the military option can be postponed.&nbsp; But under no circumstances should the military option ever be taken off the table.&nbsp; Israel must preserve its ability to <u>exercise<\/u>its fundamental right of preventive self defense.&nbsp; If possible, it should act together with other allies.&nbsp; But if necessary, it has the right to act alone to protect its citizens.&nbsp; Nearly everybody hopes that it won&rsquo;t come to that, but hope is not a policy.&nbsp; As George <u>Washington<\/u>cautioned in his second inaugural address, &ldquo;To be prepared for war is one of the most effectual means of preserving peace.&rdquo;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp;
