L’\u00c9TAT CIVIL EN TUNISIE
AU TEMPS DU PROTECTORAT FRAN\u00c7AIS<\/p>\n

Avant l’instauration du protectorat fran\u00e7ais dans la R\u00e9gence de TUNIS il n’existait pas d’\u00e9tat civil au sens moderne du terme en TUNISIE. Les communaut\u00e9s europ\u00e9ennes install\u00e9es dans la R\u00e9gence faisaient alors constater les naissances, mariages et d\u00e9c\u00e8s suivant leur droit national aupr\u00e8s de leurs repr\u00e9sentants consulaires et, si elles \u00e9taient de confession catholique, suivant le droit canonique dans les registres de paroisses dont elles d\u00e9pendaient.<\/p>\n

Au d\u00e9but du protectorat fran\u00e7ais un d\u00e9cret beylical du 29 juin 1886 a institu\u00e9 un \u00e9tat civil la\u00efc obligatoire pour les seuls europ\u00e9ens en ce qui concerne les naissances et les d\u00e9c\u00e8s mais la forme civile du mariage n’\u00e9tait pas impos\u00e9e.<\/p>\n

Un d\u00e9cret beylical du 28 d\u00e9cembre 1908 a r\u00e9gl\u00e9 ensuite l’\u00e9tat civil des seuls tunisiens pour les naissances et les d\u00e9c\u00e8s mais ce texte, mis en place par l’administration fran\u00e7aise, ne semble pas avoir \u00e9t\u00e9 appliqu\u00e9 d’une mani\u00e8re absolue.<\/p>\n

Le d\u00e9cret beylical du 26 d\u00e9cembre 1919a rendu les d\u00e9clarations de naissanceobligatoires pour tous sur le territoire de la R\u00e9gence.<\/p>\n

Un d\u00e9cret beylical du 30 septembre 1929, applicable tant aux tunisiens qu’aux \u00e9trangers, a impos\u00e9 le mariage civil lorsque l’un des conjoints est non tunisien.<\/p>\n

Au regard du droit tunisien et du droit fran\u00e7ais du protectorat les actes de bapt\u00eame et de d\u00e9c\u00e8s (dress\u00e9s avant le 1er janvier 1920) et de mariage (jusqu’en 1929) sur les registres paroissiaux par les desservants du culte catholique de l’Archidioc\u00e8se de CARTHAGE ont la m\u00eame valeur qu’un acte de l’\u00e9tat civil la\u00efc et le d\u00e9cret beylical du 3 juillet 1941 a valid\u00e9 sur le plan civil les mariages des non tunisiens c\u00e9l\u00e9br\u00e9s en la forme religieuse ant\u00e9rieurement \u00e0 sa promulgation.<\/p>\n

Le d\u00e9cret beylical du 19 f\u00e9vrier 1953 autorise, pour l’avenir, les mariages religieux entre non tunisiens si la loi personnelle des deux \u00e9poux admet cette forme; il valide \u00e9galement ceux c\u00e9l\u00e9br\u00e9s entre le 3 juillet 1941 et le 19 f\u00e9vrier 1953 toujours pour les seuls conjoints dont la loi personnelle admet cette forme. La loi fran\u00e7aise actuelle n’accepte pas les dispositions de ce d\u00e9cret beylical mais la nullit\u00e9 des mariages concern\u00e9s doit \u00eatre constat\u00e9e judiciairement.<\/p>\n

Apr\u00e8s la fin du protectorat fran\u00e7ais, la loi tunisienne du 1er ao\u00fbt 1957 a r\u00e9organis\u00e9 l’\u00e9tat civil tunisien et a rendu imp\u00e9rativement obligatoire les d\u00e9clarations de naissance et de d\u00e9c\u00e8s aussi bien pour les tunisiens que pour les \u00e9trangers. Pour les musulmans les mariages devant notaire dits \u00ab\u00a0adoulaires\u00a0\u00bb sont toujours admis mais ils doivent ensuite \u00eatre d\u00e9clar\u00e9s \u00e0 l’\u00e9tat civil la\u00efc. Il semble actuellement que, en TUNISIE, la possibilit\u00e9 des mariages religieux chr\u00e9tiens ayant valeur civile ait disparu par d\u00e9su\u00e9tude.<\/p>\n

En FRANCE et pour les ressortissant fran\u00e7ais, le d\u00e9cret du 16 juin 1962 pr\u00e9voit dans son article 2 que \u00ab\u00a0Sont assimil\u00e9s \u00e0 des actes transcrits sur les registres consulaires fran\u00e7ais les actes de l’\u00e9tat civil concernant des fran\u00e7ais figurant sur les registres \u00e9tablis par les soins du Minist\u00e8re des Affaires \u00c9trang\u00e8res par reproduction des registres de l’\u00e9tat civil tenus en Tunisie et au Maroc ant\u00e9rieurement \u00e0 l’accession de ces \u00c9tats \u00e0 l’ind\u00e9pendance …\u00a0\u00bb.
