La raison ? Il a fum\u00e9 une cigarette en public alors que le pays respecte le je\u00fbne diurne du ramadan. Le respect du je\u00fbne n\u2019est pas explicitement obligatoire mais est impos\u00e9 de fait dans ce pays tr\u00e8s religieux.<\/p>\n<\/header>\n<h4>Il fumait sa cigarette devant le tribunal pendant le ramadan<\/h4>\n<p>\u00ab Ironie \u00bb de cette affaire, l\u2019homme condamn\u00e9 fumait une cigarette le 12 juin dernier sur le parking\u2026 du tribunal cantonal de la ville !<br \/>\nL\u2019interpellation imm\u00e9diate a \u00e9t\u00e9 ordonn\u00e9e par un juge. Comparaissant dans la foul\u00e9e, il a \u00e9t\u00e9 condamn\u00e9 \u00e0 une amende de 25 dinars tunisiens (environ 9 euros) et un mois de prison ferme. Selon&nbsp;Kapitalis, m\u00e9dia tunisien, il a \u00e9t\u00e9 laiss\u00e9 libre jusqu\u2019\u00e0 la fin de la p\u00e9riode d\u2019appel, soit 10 jours.<\/p>\n<p>Les juges ont justifi\u00e9 leur condamnation en se r\u00e9f\u00e9rant \u00e0 l\u2019article 226 bis du code p\u00e9nal tunisien qui dispose qu\u2019est&nbsp;<em>\u00ab puni de six mois d\u2019emprisonnement et d\u2019une amende de mille dinars quiconque porte publiquement atteinte aux bonnes m\u0153urs ou \u00e0 la morale publique par le geste ou la parole ou g\u00eane intentionnellement autrui d\u2019une fa\u00e7on qui porte atteinte \u00e0 la pudeur. \u00bb<\/em><\/p>\n<h4>Plusieurs autres condamnations durant le ramadan<\/h4>\n<p>Quelques jours avant cette affaire, le 1er juin, le m\u00eame tribunal de Bizerte avait d\u00e9j\u00e0 condamn\u00e9 \u00e0 la m\u00eame peine quatre hommes ayant fum\u00e9 une cigarette, d\u00e9nonc\u00e9s par des citoyens.<\/p>\n<p>Pourtant, aucune loi ne punit sp\u00e9cifiquement les Tunisiens qui ne je\u00fbneraient pas lors du ramadan.<\/p>\n<p>Dans un pays marqu\u00e9 par le poids de la religion musulmane, d\u00e9peinte comme remplie d\u2019amour et de tol\u00e9rance par les m\u00e9dias occidentaux, certaines libert\u00e9s qui nous semblent essentielles restent encore hors d\u2019atteinte.
