Analyse<\/strong><\/p>\n

L\u2019Association tunisienne des femmes d\u00e9mocrates d\u00e9nonce les propos \u00ab r\u00e9actionnaires \u00bb du pr\u00e9sident Ka\u00efs Sa\u00efed, qui a d\u00e9fendu les valeurs musulmanes d\u2019\u00e9quit\u00e9 et de justice plut\u00f4t que d\u2019\u00e9galit\u00e9, \u00e0 l\u2019occasion de la f\u00eate de la femme, le 13 ao\u00fbt.<\/p>\n

L\u2019\u00e9galit\u00e9 en mati\u00e8re d\u2019h\u00e9ritage est un \u00ab faux d\u00e9bat \u00bb et il \u00ab n\u2019est gu\u00e8re innocent \u00bb. Le pr\u00e9sident tunisien Ka\u00efs Sa\u00efed a choisi le jour de la F\u00eate nationale de la femme, le 13 ao\u00fbt, pour donner un dernier coup de boutoir au projet de loi sur l\u2019\u00e9galit\u00e9 en mati\u00e8re d\u2019h\u00e9ritage.<\/p>\n

Son pr\u00e9d\u00e9cesseur, le pr\u00e9sident B\u00e9ji Ca\u00efd Essebsi, d\u00e9c\u00e9d\u00e9 en juillet 2019, avait ouvert ce chantier r\u00e9volutionnaire en terre d\u2019islam (les femmes musulmanes n\u2019h\u00e9ritent que la moiti\u00e9 de la part des hommes) en 2017, \u00e0 la fois pour damer le pion au parti des Fr\u00e8res musulmans Ennahda, et pour marquer de son sceau l\u2019histoire de la Tunisie. Mais le projet de loi avait \u00e9t\u00e9 critiqu\u00e9 par les progressistes parce qu\u2019il laissait la possibilit\u00e9 d\u2019\u00e9chapper \u00e0 l\u2019\u00e9galit\u00e9. Et il avait surtout affront\u00e9 une forte r\u00e9sistance au Parlement o\u00f9 il \u00e9tait rest\u00e9 bloqu\u00e9.<\/p>\n

Conservateur sur le plan des m\u0153urs, Ka\u00efs Sa\u00efed avait d\u00e9j\u00e0 soulign\u00e9 son opposition personnelle au projet d\u2019\u00e9galit\u00e9 successorale avant son \u00e9lection en octobre 2019. C\u2019est en chef de l\u2019\u00c9tat qu\u2019il s\u2019est cette fois-ci r\u00e9f\u00e9r\u00e9 au texte coranique et \u00e0 ses valeurs d\u2019\u00e9quit\u00e9 et de justice en mati\u00e8re de succession. \u00ab L\u2019\u00e9galit\u00e9, telle que con\u00e7ue par la pens\u00e9e lib\u00e9rale, n\u2019est que formelle et n\u2019est pas fond\u00e9e r\u00e9ellement sur la justice \u00bb, a-t-il plaid\u00e9, rapporte l\u2019agence officielle Tap. Les Tunisiens ont, selon lui, fait la r\u00e9volution pour r\u00e9clamer libert\u00e9, dignit\u00e9 et justice sociale, et non pas pour revendiquer l\u2019\u00e9galit\u00e9 dans l\u2019h\u00e9ritage.<\/p>\n

La Constitution est \u00ab bourr\u00e9e de pi\u00e8ges \u00bb<\/strong><\/p>\n

\u00ab Une lecture du principe d\u2019\u00e9galit\u00e9 proprement r\u00e9actionnaire \u00bb, s\u2019\u00e9trangle Yosra Frawes, la pr\u00e9sidente de l\u2019Association tunisienne des femmes d\u00e9mocrates (ATFD). \u00ab C\u2019est la premi\u00e8re fois qu\u2019un pr\u00e9sident ne promet aucune mesure en faveur des femmes \u00bb, souligne-t-elle. Alors que le 13 ao\u00fbt, jour de c\u00e9l\u00e9bration du code du statut personnel, est d\u2019ordinaire une date propice aux engagements, dans le sillage du texte fondateur de 1956 qui amor\u00e7a l\u2019\u00e9mancipation des femmes en Tunisie avec l\u2019abolition de la polygamie, l\u2019instauration du mariage par consentement mutuel, l\u2019autorisation du divorce, etc.<\/p>\n

\u00ab La Tunisie qui se voulait la locomotive des pays arabes est en panne \u00bb, s\u2019attriste Naila Silini, islamologue \u00e0 l\u2019universit\u00e9 de Sousse. \u00ab Le pr\u00e9sident veut nous faire croire que le Coran est un texte clair, ferm\u00e9, qu\u2019il n\u2019y en a qu\u2019une seule lecture, analyse-t-elle. Or Ka\u00efs Sa\u00efed se base sur la charia qui est l\u2019interpr\u00e9tation humaine du Coran, et non pas sur le texte sacr\u00e9 lui-m\u00eame qui est ouvert aux interpr\u00e9tations. \u00bb<\/p>\n

Selon elle, le pr\u00e9sident, en constitutionnaliste reconnu, sait que ses propos sont compatibles avec la Constitution tunisienne de 2014. Si toute r\u00e9f\u00e9rence \u00e0 la charia en a \u00e9t\u00e9 exclue gr\u00e2ce \u00e0 une vaste mobilisation des mouvements modernistes, la Constitution reste \u00ab bourr\u00e9e de pi\u00e8ges \u00bb, selon l\u2019islamologue.<\/p>\n

Ainsi, en vertu de l\u2019article 21, les citoyens et les citoyennes sont \u00e9gaux en droits et en devoirs. \u00ab Cela signifie que l\u2019\u00e9galit\u00e9 ne vaut que dans l\u2019espace public, mais pas au sein des familles o\u00f9 la femme est \u00e9pouse, fille, m\u00e8re ou s\u0153ur \u00bb, explique-t-elle. \u00ab Les voix favorables \u00e0 l\u2019\u00e9galit\u00e9 se sont rar\u00e9fi\u00e9es \u00bb, s\u2019inqui\u00e8te Yosra Frawes qui appelle \u00e0 la lutte contre \u00ab les forces r\u00e9trogrades qui gagnent du terrain \u00bb.<\/p>\n","protected":false},"excerpt":{"rendered":"
